Privacy Policy Falkann

1. Collection of personal data

1.1 Falkann collects personal data from customers and visitors to the webshop when they:

  • visit the webshop;
  • create an account;
  • place an order;
  • contact Falkann;
  • subscribe to a newsletter or other marketing communications, where applicable.

1.2 The personal data that Falkann may process includes, among other things:

  • name and address details;
  • contact details, such as email address and phone number;
  • payment details;
  • order and return details;
  • IP address and data about the use of the webshop, where applicable;
  • other personal data voluntarily provided by the customer.

2. Purposes of data processing

2.1 Falkann processes personal data solely for legitimate and clearly defined purposes, including:

  • processing and handling orders and payments;
  • delivering products and services;
  • customer service and support;
  • providing information about orders, returns or questions;
  • improving the webshop and services;
  • marketing and promotional purposes, insofar as consent has been given or another valid legal basis exists;
  • complying with legal and administrative obligations.

3. Legal basis for processing and consent

3.1 Falkann processes personal data only when there is a valid legal basis for doing so, such as:

  • the performance of an agreement;
  • the consent of the data subject;
  • compliance with a legal obligation;
  • a legitimate interest, insofar as permitted under the GDPR.

3.2 Insofar as processing is based on consent, the user has the right to withdraw that consent at any time via info@falkann.nl.

3.3 Withdrawal of consent does not affect the lawfulness of processing before the withdrawal.

4. Sharing personal data with third parties

4.1 Falkann shares personal data with third parties only when this is necessary for:

  • the performance of the agreement;
  • processing payments;
  • delivery of orders;
  • IT and hosting services;
  • compliance with legal obligations.

4.2 Falkann does not sell personal data to third parties.

4.3 If Falkann uses external service providers who process personal data on behalf of Falkann, appropriate arrangements will be made where necessary, for example in a data processing agreement.

5. Security of personal data

5.1 Falkann takes appropriate technical and organisational measures to protect personal data against loss, misuse, unauthorised access, unwanted disclosure and unauthorised modification.

5.2 These measures are adjusted where necessary to the nature of the processed data and the state of the art.

6. Retention period

6.1 Falkann does not retain personal data longer than necessary for the purpose for which it was collected, unless a legal retention period applies.

6.2 Data required for tax administration or other legal obligations will be retained for as long as required by law.

7. Rights of data subjects

7.1 Users have the right to request access from Falkann to the personal data processed about them.

7.2 Users have the right to have inaccurate or incomplete personal data corrected or completed.

7.3 Users have the right, in certain cases, to request the deletion of their personal data.

7.4 Users have the right to have the processing of their personal data restricted in the cases permitted under the GDPR.

7.5 Users have the right to data portability, insofar as this is legally applicable.

7.6 Users have the right to object to the processing of their personal data.

7.7 Users have the right not to be subject to solely automated decision-making, including profiling, where this produces legal effects or similarly significant effects.

7.8 Falkann will in principle respond within one month to a request relating to privacy rights, as is customary under the GDPR.

8. Cookies and website use

8.1 Falkann may use cookies or similar techniques on the webshop for the functioning of the website, analytics and marketing, where applicable.

8.2 Insofar as legally required, Falkann asks for prior consent for the placement of non-essential cookies.

8.3 More information about the use of cookies may be included in a separate cookie policy or cookie statement.

9. Changes to this privacy policy

9.1 Falkann reserves the right to amend this privacy policy.

9.2 The most recent version of the privacy policy will be published on the webshop.

9.3 In the event of significant changes, Falkann will inform customers accordingly.

10. Complaints and contact

10.1 For questions or requests regarding this privacy policy, Falkann can be contacted via info@falkann.nl.

10.2 Users also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) if they believe that Falkann is not processing their personal data correctly.
