Terms and Conditions Falkann
1. Applicability
1.1 These terms and conditions apply to all offers, agreements, orders and transactions between Falkann, hereinafter referred to as: “the Seller”, and the customer, hereinafter referred to as: “the Buyer”.
1.2 By placing an order via the Falkann webshop, the Buyer accepts these terms and conditions.
1.3 Deviations from these terms and conditions are only valid if expressly agreed in writing.
2. Product information
2.1 Falkann strives to describe all products on the webshop as completely and accurately as possible, including price, specifications and delivery information.
2.2 Obvious errors, mistakes, typographical errors or evident omissions in the offer, prices or product information are not binding on Falkann.
2.3 Images and product specifications on the webshop are indicative. Minor deviations do not entitle the Buyer to terminate the agreement or claim compensation, unless there is a material deviation in the delivered product.
3. Order and payment
3.1 The Buyer places an order by fully completing the steps of the checkout process on the Falkann website.
3.2 The agreement is concluded at the moment Falkann confirms the Buyer’s order.
3.3 Payment must be made in the manner indicated during the checkout process.
3.4 Falkann reserves the right to refuse an order or impose additional conditions if there is a reasonable basis for doing so, for example in the case of incorrect details or suspected misuse.
4. Delivery
4.1 Falkann will make every effort to deliver orders as soon as possible after receipt of payment.
4.2 If no specific delivery period has been agreed, delivery will take place within 30 days, unless otherwise agreed.
4.3 Delays in delivery will be communicated to the Buyer as soon as possible.
4.4 The risk of damage to and/or loss of products remains with Falkann until the moment of delivery to the Buyer, unless expressly agreed otherwise.
5. Right of withdrawal and returns
5.1 The Buyer who is a consumer has, in many cases for an online purchase, the legal right to withdraw from the agreement without giving any reason within 14 days after receipt of the goods.
5.2 In addition, Falkann voluntarily offers a 30-day return period after receipt of the goods. Within this period, the Buyer can register a return.
5.3 After registering the return, the Buyer has at least another 14 days to actually return the goods.
5.4 If the Buyer exercises the right of withdrawal or the return period offered by Falkann, the product must be returned to Falkann with all delivered accessories and – as far as reasonably possible – in its original condition and packaging.
5.5 The Buyer must handle the product and packaging with care. If the product is damaged or the packaging is damaged more than necessary to assess the product, Falkann may charge this diminution in value to the Buyer.
5.6 Certain products may be excluded from the right of withdrawal or return, insofar as legally permitted, such as personalised goods or products that spoil quickly. These exclusions are clearly stated in the relevant product information.
6. Refund
6.1 After a valid withdrawal, Falkann will refund the purchase amount no later than within 14 days.
6.2 Falkann may withhold reimbursement until the returned product has been received, or until the Buyer has demonstrated that the product has been returned, whichever occurs first.
6.3 The refund will be made using the same payment method as that used for the original payment, unless expressly agreed otherwise.
7. Warranty and conformity
7.1 The Seller guarantees that the delivered products conform to the agreement and the applicable legislation.
7.2 The Buyer is entitled to a product that meets what they may reasonably expect from it. In the event of a defect, the Seller must provide a solution, such as repair, replacement or, in certain cases, termination of the agreement.
7.3 Any additional warranty terms or manufacturer’s warranties will, where applicable, be stated on the Falkann website. An additional warranty does not affect the Buyer’s statutory rights.
8. Liability
8.1 Falkann’s liability is limited to direct damage and to a maximum of the value of the delivered goods or the amount of the relevant order, insofar as legally permitted.
8.2 Falkann is not liable for indirect damage or consequential damage, including but not limited to loss of profit, loss of savings or damage to third parties, unless there is intent or wilful recklessness.
8.3 Nothing in these terms and conditions is intended to exclude or limit liability insofar as this is not permitted under mandatory law.
9. Complaints procedure
9.1 Complaints about products or services must be submitted in writing or by email within a reasonable period after discovering the defect.
9.2 Falkann will respond to complaints within a reasonable period, and preferably within 14 days, and will try to resolve them to the best of its ability.
9.3 Dispute mediation: Falkann is affiliated with WebwinkelKeur. In disputes that cannot be resolved by mutual consultation, the consumer must contact WebwinkelKeur. WebwinkelKeur offers mediation in consumer disputes and also states that a dispute may be referred to DigiDispuut, where a binding decision may be issued. According to WebwinkelKeur, this includes, among other things, that the amount in dispute must be between €25 and €25,000 and that the consumer pays a one-time contribution of €25, which may be recovered from the webshop if the consumer is found to be in the right.
9.4 Verification of a current membership can be carried out via the WebwinkelKeur members list.
9.5 Online Dispute Resolution (ODR): The previous reference to the European ODR platform is no longer current, because this platform was discontinued on 20 July 2025.
10. Applicable law and dispute resolution
10.1 These terms and conditions and all agreements between Falkann and the Buyer are governed exclusively by Dutch law.
10.2 Disputes will be submitted to the competent court, with due regard for mandatory consumer protection rules.
